Discussion On "Administrative Compulsory Law" On Compulsory Administrative Measure Regulation

The public security administrative enforcement of law philosophy is the changeof two respects: from administration to service administration transformation, frompay attention to pay attention to the protection of human rights of administrativepower transformation. And " the administrative compulsory law " of administrativecoercive measures, procedures, main types and make specific provisions, the publicsecurity organs to implement the administrative coercive measures put forward higherrequirements, and these requirements is public security organs of the two changereflect, is associated with the administrative compulsory legislation spirit consistent.The public security law enforcement idea transformation is conducive tostrengthening and the relative person’s communication, and the relative person toestablish mutual trust and cooperative relations, to provide appropriate services,thereby weakening the color management, enhance service awareness.This paper mainly from the following aspects:First of all, the concept, characteristics of compulsory administrative measures asthe starting point, introduced the public security organs of administrative compulsorymeasures position and action, emphasize the public security administrative coercivemeasures is not only the realization of the administrative objective means, moreattention should be paid to serve the public interest and the protection of human rights value orientation.Secondly, based on the current situation of public security administrativeenforcement measures are analyzed systematically, pointed out in the practice of lawenforcement of public security administrative enforcement measures, the abuse ofprocedures as a result of related adverse consequences, put forward to perfect thepublic security administrative enforcement measures relevant countermeasure andproposal.Finally, this paper points out that the public security organs in the construction ofsocialist country under the rule of law in the context of, shall comply with theprovisions of relevant laws and regulations, revised and improved as soon as possible,perfect public security administrative enforcement measures implementationprocedure, and puts forward some improvement of our country’s public securityadministrative compulsory measures system think with the proposal.
