Constitutional Culture And Its Construction

This paper expands mainly around the questions of constitutional culture and its construction, and it explores successively the concept of constitutional culture, the importance and significance of constitutional culture, the major representations and reasons of the deficiency of constitutional culture in China nowadays, the constructional ways of constitutional culture in China. It divides into four parts.In the first part, it makes firstly a summary of the realization of culture, legal culture and constitutional culture in academic circles at present in China and abroad, and on the basis of which gives the author's definition of constitutional culture. In order to make a more profound realization or understanding of constitution culture, it discusses next the connection and difference between constitutional culture and culture of constitutionalism, constitutional consciousness and constitutional idea.In the second part, it analyses and proves the importance and significance of constitutional culture, considers it mainly include promoting the establishment of constitutional authority, propelling and guiding the enactment, amendment and interpretation of constitution, ensuring the implementation of constitution, promoting the operation of law, and propelling the building of democratic politics.In the third part, it mainly investigates the major representations of the deficiency of constitutional culture in China in the present, including several aspects such as lack of the core value idea of constitution, underdevelopment of constitutional theory, indifference of people's constitutional consciousness and constitutional idea, inestablishment of people's constitutional belief and so on, and then discusses the causes that include traditional culture especially traditional legal culture, development of constitutional jurisprudence, making and implementing mode of constitution, guarantee of implementation of constitution.In the fourth part, it summarizes and points out the constructional way of constitutional culture that mainly include four big aspects as system building, constitutional education, research of constitutional jurisprudence and publicity and popularization of constitution that every one can be divided into two small aspects which are relatively divided, meanwhile, connected with each other, etc.
