Research On The Problems Of Administrative Guidance Procedure Of China

With the use of administrative guidance more and more widely in China, many scholars have pay more and more attention to the problem of administrative guidance. At present, many inevitable problems are arise in application of administrative guidance, because the laws and regulations are not enough to regulate administrative guidance, especially the lack of procedural safeguards. The key to development the China's administrative is to consummate laws of China's administrative system and to improve the procedures for administrative guidance .The main purpose of this paper is to analyze the problem of China's administrative procedures in theoretical basis and practical issues, aimed at give some advice for the development of China's administrative procedures.The main contents of this paper include the following: First, On the basis of the basic theory of administrative guidance and administrative guidance procedures, expatiate the important role of the procedures for administrative guidance, and at last we adduce the best choice to develop China's administrative is procedural regulation. Secondly, start from the current situation of administrative guidance, analyzes the problems of procedures for administrative guidance in theory and practice. Finally, adduce the countermeasures to perfecting the administrative procedures from three areas, that is:before,in and after the use of administrative.The novelty of this paper, lies in the fact that the use of a combination of theory and practice and the comparative study of methods, from a procedural point of view the construction of administrative guidance of China's development problems, the analysis of these issues based on the guidance of China's administrative procedures development.
