Study On Current Situation And Problems Of Local People's Congress's Supervision Function

The people's congress system serves as China's basic form of regime.All power in China belongs to the people,and the organs through which the people exercise state power are the National People's Congress and the local people's congresses at different levels.The Constitution and the law ensure the people's congress the power of legislative,superintendence,decisions on major issues and appointment or removal of officials.The supervisory power is the basic function for local people's congresses and their standing committees,which used most frequently.Since established,standing committees of the local people's congresses have been improving the people's congress system,strengthening the supervisory work for three decades.They have done plenty of work carrying out active explorations and bold practices.Thus,they have accumulated rich experience in strengthened supervision,continuous innovation as well as practical work.However,due to various historical and practical reasons,the supervision is still a weak aspect,which is also the most concerned issue for the public.The promulgation and implementation of the Supervision Law is of great practical and far-reaching historical significance for the local people's congresses to exercise their supervisory functions,improve supervisory mechanism,strengthen and improve supervision,enhance the effectiveness of supervision,promote the administration by law and fair administration of justice,further develop the characteristics and advantages of the people's congress system,and promote the building of socialist and democratic rule of law.It is necessary to take the implementation of the Supervision Law as an opportunity to further strengthen and improve the people's congress supervision.At present,China has entered the new stage of development for a well-off society and the acceleration of the socialist modernization.The people's congress is facing more and more new situations,new tasks and new demands.To strengthen the supervisory function of the local people's congresses is of great significance for the continuous improvement of the people's congress system,the promotion of socialist and democratic political establishment and the rule of law,the insurance and promotion of China's reform and opening up and the development of modernization.In recent years,local people's congresses at different levels have conducted a number of active explorations and improvements in strengthening the supervisory work. Generally speaking,the supervisory work is in the process of transformation from procedural supervision to substantive supervision,and the exercise of supervisory power is not yet fully in place.For instance,although there are a lot of specific measures in the supervision over the national economic and social development plans, budgets and the implementation,most supervisory channels are not wide enough,the means are not hard enough and the effect is not obvious enough.As for the election of the people's congress and its standing committee and the appointment of cadres, supervision often comes into effect after problems appear and is conducted as a nominal supplement.Real punishment implemented through the supervision of the people's congress is of a small proportion.Certain major issues concerning the overall situation and the hot issues with great concern to the general public are not settled in time,due to the lack of in-depth understanding and proper disposal measures.In the choice of supervisory means,such means designated by law as inquiry,question, specific investigation,removal from office and recall are seldom used,and as a result, the supervision of the people's congress is to some extent not powerful enough and the power is not well exercised.This paper makes a case study of Putuo district,Shanghai to discuss the status quo of the current functioning of county people's congress,and analyzes the problems existing in its supervision,including the concept of supervision,supervision system, supervision capacity and the effect of supervision.Based on the above situation,the author makes a number of observations on how to improve the supervision of local people's congress,starting from the status quo and problems of the local people's congresses and their standing committees in supervisory functioning,and from the perspectives of strengthening the awareness of supervision,specifying supervisory functions,implementing the supervision according to law,enhancing authority, improving the supervisory mechanism,strengthening budget supervision,emphasizing the development of the people's congress and strengthening its power.
