The Rule-of-law Exploration Of The Third Sector

This dissertation focuses on the third sector in the society with the rule of law.It discriminates the concept and characteristic of the third sector,and tracks down the origin of the third sector with rule of law.Except for making the sense of the third sector to the society with the rule of law clear,this dissertation will discuss the nomocracy support from the government and the society.This dissertation includes four parts besides the introduction and the epologue.The main content of it will be resumed as follow.The first chapter is about the concept,characteristic,and classification of the third sector.It integrates many famous academicians' frame of reference in order to make a scientific,authoritative, and clear definition.This will establish the base for the later study.The second chapter is about the theory of the civil society. The civil society and the country came through a process from confronting to cooperation.We relate this process to the history of the third sector in our country,and receive some revelation.The third chapter explains the relationship between the model of restricting public power and the third sector,and dicusses the positive sense of restricting public power by the third sector. Comparing the model of "restricting public power by social power" to the model of "restricting public power by public power",we get the right model of restricting public power according to our country.The fourth chapter is concerned about the important meaning of the third sector to the nomocracy.The important and the necessary of the third sector is affirmed.In order to develop the third sector, we must establish a whole law system of it.
