Research On Some Issues Of The Court Entrusting Mediation System

Entrusting mediation system is a major innovation of alternative dispute settlement mechanism in our country, which has many functions, such as alleviating the court pressure, reducing dispute resolution cost, mobilizing the social strength to resolve dispute effectively and creating a harmonious society. This system has already been promoted over the country, but the Supreme People's Court does not make any specific provisions for entrusting mediation system. Different courts have different ways of exploration to entrusting mediation and some courts which start early even create some characteristic pattern.However, the legal theory society has not given due emphasis on the research of the entrusting mediation in the past time, the theoretical research on it is also deficient. The nature, scope, pattern of practice, procedure and other aspects of the entrusting mediation still need further discussion and study. This paper attempts to explore these issues, and then give some suggestions in developing and improving entrusting mediation system to make it more regulated.
