The local legislation plays an important role in our country's legislative system. It is the essential supplement of the central legislation. At present, there are more than 170,000 pieces of local legislation files in china including a large number of independent local laws and regulations. These local regulations perfected the legislation of the central government and provided a lot of experience for the legislation of the central government as well as a powerful legal guarantee for economic and cultural development of the local society. However, due to the differences of awareness, knowledge, and profession level towards the local legislation, as well as the lackness of standard guideline of local legislation, the quality of independent local laws and regulations varied greatly, even legality problems exist. The article attempts to give some advice on perfecting Chinese independent local legislation, and explore the theories and status quo on local legislation.Firstly, the author explores the legal principle basis and the necessity and effect of local legislation through analyzing the conception, the legal basis as well as the specific function, which laying the groundwork for the regulation innovation of local regulation. Secondly, the status of Chinese local legislation was shown with aspects of developing process, the legislative option and the for selected, the situation of legislative principle and authority followed, suggesting its shortcomings and deficiencies, as well as the difficulties on carrying out local laws and regulations caused by them. Finally, according to the facts of Chinese local legislation and advanced experience from aboard, advice was given on perfecting Chinese local legislation.
