Analysis On Hangzhou Drag Racing Case

With the china's reform and opening up to the outside world, the drag racing has become the common phenomenon in today's society. People's increasing living standard leads to emerging of road killer. At the same time, the more and more younger people have taken part in drag racing which in turn poses great dangers on public security. With the popularity of drag racing cases, some arguments about identifying drag racing also emerges. Some legal experts hold opinion that given such cases is very dangerous to the society, so this kind of cases should be convicted as crime of endangering public safety in a dangerous way, while others believe traffic offence is more justified. Since such case has great danger to social security, public safety and property, the writer therefore takes "Hubing" drag racing case as focus to organize and analyze relevant materials with aim to discover some valuable clues. In addition to factors abovementioned, writer also digs both objective and subject factors involved in this case in an attempt to propose some constructive suggestions and recommendations.This paper consists of three parts, the first part is to define the drag racing and analyze it from the perspective of law; the second part is the key to this paper which focuses on analyzing different opinions and reasons on HangZhou case, then, on the basis of crime constitution, the writer analyzes and compares three point of views, concluding that the criminal of this case should be convicted as crime of endangering public safety in a dangerous way. In the third part, the writer digs root cause of this phenomenon and presents some measures against this phenomenon adopted by overseas regions and nations. In this part, writer's own suggestions and recommendations also attached. The writer also elaborates on how to prevent such crime by means of legislation and civil compensation in an attempt to help judicial organs to deal with such case in the future.
