The Research On Environmental Liability Insurance

With the rapid development of economy, the environmental problems become serious in China. The environment pollution will become social problem! How to compensate the victims has become the main contents of environmental law.This paper raises the problems one on compensation system in environmental tort. The environmental liability insurance is one of the effective methods to make compensations for the environmental damage. Taking environmental liability insurance could make the following 3 goals come true:"Making quick compensation for the victims", "Make polluter paying for the pollution" and "Reducing pollution". The facts that the legal system being imperfect, the corporate insurance demand being low and lack of market supply, restrict the environmental liability insurance lunching in China. This article referenced mature environmental liability insurance system in developed country, analyzed the situation of environmental liability insurance in China, proposing that we should perfect the environmental liability insurance through the Insurance model, Insurance agencies, Insurance liability and premium rate, which is expected to make full exertion of its function.
