The Legal Attribute And Protection Of The Network Virtual Property

With the popularization of computer, tens of thousands of computers have gone into people's life. People carry on all kinds of virtual activities through the network of virtual space, especially when online games appears, the transaction of virtual property increases frequently. At the same time, the dispute about virtual property increases too. As the law does not explain it clearly, so many scholars have a lot of controversies on legal attribute of virtual property.In the first chapter, I put forward the definition of virtual property through analysis of the views of other scholars. Meanwhile, the characteristics of virtual property are discussed in the first chapter.In the second chapter, I came to a conclusion that virtual property belongs to property of civil law by studying differences among the matter, property and property rights. After I review the viewpoints of various scholars on the legal attribute of virtual property right, I make a definition of virtual property right that a new right which is based on creditor's rights.In the third chapter, I propose my own concept of legal protection by studying status of the virtual property protection of abroad and domestic. According to disputes between users and operators, disputes of the third party with users and operators, disputes between users and the third party, I propose solutions.
