On The Standards Of Voluntary Confession

Chinese existing laws on the judgment of voluntary confession is essential judgment. The efficiency of this kind of judgment is very low, so that it could not ban illegal question and vulnerable to violations of the rights of voluntary criminal suspects. Throughout the countries and regions of developed law system, the judgment of voluntary confession is formal judgment. We find that the formal verification has become a general practice. Formal verification is consisted of the procedural safeguards and proof of voluntariness, in order to determine the form of voluntary confession. Protection rules from the procedural violation is the exclusion of the confession of the absolute effect of view, there are strict verification and formal verification. I try to analyze the reasons for the formation of two formal verification, then building standards of voluntary confession from the standpoint of balance crime control against protect human rights.
