Abettors, who instigate others to commit crimes, are not only the instigators but also the disseminator of criminal intent. The behavior of abettors not only indicates that the abettors themselves have distinct nature of opposing society and immense subject malignancy, but also they can trigger the criminal intention of those who are instigated, and they may perform some criminal actions that are harmful to the society. The mechanism of the crime lies in that the abettors not only commit a crime but also create perpetrators. Its dual harmfulness makes us to investigate the punishments to the abettors, and also makes it important to investigate criminal responsibility.In the premise of following the principle of legality, this paper adopted a comparative study and combines theories with practice. Firstly, it makes a brief introduction and definition of the establishing conditions and nature of the abettors. Secondly, by investigating the foundation and principles of the punishments to the abettors, this paper discussed the punishments to the abettors in Chinese current criminal law. Lastly, this paper focused on dealing with the four problems about the punishments to the abettor in judicial practice, including the punishment to the attempted abettors, the punishment to identity abettors, the punishment to the abettors in joint crime as well as the punishment to network abettors.
