Concerning On The Consistency Of The Law

The reason why legal inconsistent very complex. There are has inevitable reasons (such as: the law with purpose, undistributed, hysteresis), and also has accident reason (violating the logical law of non-contradiction).From the point of the view of law of non-contradiction, this paper to inspect and analyze the phenomena which the law of non-contradiction from legislation (legal system) and application of the law,and discuss the consistency of the law.This paper includes the following three parts:The first part is to analyze and inspect the basic concepts related to law: first, by detailed analysis of the concepts of law to reveals the essence of law. Secondly,this paper will explore the concept of "consistency" from the etymology and logical perspective,so as to to reveal the logical meaning of "consistency".On the view of law of non-contradiction ,the second part will discuss the consistency of the legal from three aspects: legal concepts, legal norms and the overall coherence of the law.On the view of law of non-contradiction, the third part will discuss the consistency of the legal from two aspects: the evidence, judicial activities.
