Study On Several Problems Existed In The Current Rural Houses Dismantlement

More and more rural houses were demolished because the urbanization process was promoted. There are many problems in the current rural housing demolition work, and these problems existed in many aspects such as the demolition of the main,the demolition process, the right to relief which was resulted in lack of relevant laws and regulations in our country . This article is written in the view of the status quo of China's demolition, through practice, and to consider the problems underlying the situation in order to recommend practical and effective solution. And in this passage, the writer analyses the demolishing purposes whether be public interests and through this to divide the different demolition subject, demolition process, compensation methods, and in order to enhance using operability in the practice.In addition to preface and conclusion, this passage is divided into four parts:First, summarize the current rural house dismantlement such as contains the demolition legislation, demolition of actual operation procedure and etc. Second, conclude the rural problems in the demolition. Including lack of legal subject, public interests is indefinite, demolition process illegal, compensation and remedy mechanism etc. Third analyses the reasons existed in current rural house dismantlement work, this paper includes: the dismantlement administrative organs, government function, the interests of rural land rights, the main defects. And at the last, tries to solve the problems were referred.
