Citizens'right to equal education is a constitutional right in China. China has made a great progress in compulsory education through efforts of many years. However the application of the right to higher education in reality is unsatisfactory. The key issue is that the right to education is unequal both in form and in essence. As is a constitutional right, discussing the right to equal education under the Constitution is necessary. China and India has many similarities in national condition. And both countries'higher education is also facing the similar development background. The higher educational system of Indian is relatively complete, and has an effect on protection of the right to equal education. The Constitution of India has specific stipulation on the right to equal education which is very important to protect the right. Comparative study on the right to equal education of China an India has many practical significance to reform of educational system of China. This essay consists of four parts. The first part is about analyzing the meanings, contents and significance of the right to equal education. The second part concentrate on the regulations and cases of Indian educational system in terms of three aspects, protection of the right to education, protection of the right to equal education and affirmative action. The third part analyzes the problems exist in the application of the right to higher education any lay much emphasis on regional discrimination. The fourth part is discussing the Indian experience in protecting the right to equal education. And in three angles of legal text, relief ways, and enrollment system reform, seek ways to improve the application of the right to equal education.
