You may even participate in this interesting transaction, but I wonder that how many persons know this transactional mode have made the incredible economic benefits during the global financial tsunami. Plenty of trade volumes by internet-group-buying are established everyday; however, there are many disputes happened, but no specific regulations and precedents to follow. Choosing internet group-buying to research and analyze the legal relationship is necessary but difficult because of few bibliographies to refer.Except the preface and conclusion, this paper is divided four parts to study on the issue of internet group-buying. In the first chapter, I will introduce the background, current situation and modes of internet-group-buying and mention on the necessity to study. In the second chapter, I will state the legal regulations in electronic commerce of main countries or areas; furthermore, under such particular transactional environment, the time-point of the contract formation is very crucial, because it is a key factor to decide the parties'rights and obligations. In the third chapter, I will discuss the essence of the internet-group-buying contract, the issues of consignment and related subordinated obligations. In the forth chapter, I will define the legal relationship of the main buyer and each members involved in one internet-group-buying contract by means of Taiwanese mutual fund system; moreover, I will also discuss Chinese cooperative and make a comparison with Taiwanese mutual fund system to figure out which one is better for my topic. In conclusion, I consider that internet group-buying contract belonged to nameless contract; in this case, when disputes happened, there will be better solutions for two parties.
