Study On Remedy Of Environmental Tort

At present,the protection and legal relief of social vulnerable group have became a secious social problem.the rights of the vulnerable group are very fragile,as its few resource possesstion,the poor degree of realization of rights and bad labor circumstance.In order to protect rights of the social vulnerable group,the foundation of environmal remedy system is necessary.The author think the remedy system of environmental tort should includes two parts.The first part is legal remedy system,the another is social remedy system.In china, the social remedy system is most important.This test divides into four parts wholly. The first part is the defenition and characters of the social vulnerable group,the second part mainly discuss the definition of environmental right. The third part includes foreign environmental remedy system and Chinese situation,inluding Japan,German and America.Such precious experience about the theory and practice is very useful for us, author appraises the actuality in our country about the remedy of environmental tort.The most purpose of this part is absorbing advanced experience from other countries.The last part of this article is foundation and perfection of environmental remedy system for vulnerable group in our country.We construct from two respects mainly the remedy in legal and social.Among them,the remedy in social aspect is the point in this thesis.And the most important aspect of the remedy in advance is the development of environmental education, the environmental insurance and environmental protection organization.
