On The Human Rights Protection Of Social Vulnerable Group

Academic has been concerning the problem of social vulnerable group for a long time. After our state has raised the aim of establishing the harmonious society, the very problem is made to be a very hot topic. Since the reform and opening up policy has been taken in our state in 1970s, our economic system changed a lot, accompanying with which our industrial structure, distribution system and employment system also changed. At this background, the two poles of the rich and the poor become more and more obvious, and the scale of social vulnerable group becomes wider and wider, their disadvantages become more and more apparent. With the development of Reform and opening up, the problem of social vulnerable group becomes a problem that we need to solve immediately. As to the academic discussion, we pay more attention to the problem from the angle of sociology. However, the problem of social vulnerable group cannot be solved only in sociologic way; the problem itself is also a problem of legal question. If we want to get an ultimate solution, we should think about it in the perspective of law and the human rights protection. By discussing the problem from a constitutional angle, this dissertation makes great effort to find ways to protect the human rights of social vulnerable group.The first part of this dissertation trys to establish the legitimate basis of protecting the social vulnerable group's human rights from three aspects, including human rights protection, social justice and social harmony. Upon the analysis before, this dissertation then raises two notions concerning the protection of their rights, one is the standard of rights and the other is the same concerning upon the relief and developing rights of vulnerable group.The second part of this dissertation does a lot of research on the protection system of social vulnerable group's rights aboard. Based on summarizing the system aboard, this dissertation concludes their experiences, compared with which it raises several defects in our state.Based on the consideration of our state's traits, the last part of this dissertation puts forward some advices on the measures to consummate our state's human rights protection of social vulnerable group. This dissertation also believes that if we want to solve the problem utterly, we need not only establish a system to remedy their rights, but also set up a developing system to help them change their disadvantages.
