Some Law Problems Study On The People's Mediation System

This paper aims to discuss the existent problems of the developing of the people's mediation system in this stage from the characteristics and the nature of people's mediation system and the value of in the modern society, and analyzes the problems and put forward countermeasures to improve. By analyzing concerned legal regulations, we found some people's mediation organization, staff and the people's mediation agreement are not adapt to the needs of the social development. Because of the lack of government's investment, at this stage the development status and the stability of the mediation team should not be ignored. Mediators also remains simple persuasion and education, the lack of blinding mediation agreement and execution, the parties may pull back at any time, lead to the people's mediation agreement and the implementation and procedural problems are not smooth,which seriously restrict the development of people's mediation system, urgently need to resolve the above problems.Through comparing and analysis to the mediation legislation of the foreign and Chinese Taiwan area, identifying the same or similar content with our country, and to learn. Establishing the legislation principal of people's mediation system, perfecting the system of mediator's composition and selection and mediation program, confirming people's mediator system type of solving disputes, learning the system of the risk punishment, and enhancing the effect of mediation agreement. To solve the people mediation system restricts the development of obstacle:the lack of government's input, courts and judicial administrative organs concerned. Further smoothing the relationships of people's mediation, judicial mediation and forensic mediation, people will end to the disputes, to maximize the role of maintaining social stability.
