The Lawyers And The Building Of American Constitutional System

On the base of 1787 Constitution of the United States and "the Bill of Rights", a relatively complete constitutional system is formed and developed in the world,which reflects the concept of democracy and scientific design of separate of powers and checks and balances. The constitution not only ensures fast economic development, long political stability and maximum security of social rights since the the United States founding 200 years ago, but also produces huge positive effects to other countries'modern constitutional undertaking, including China.Through the preliminary investigation, one important reason of the great achievements of the American constitution is that the outstanding framers made a creative combination and development of actual social situation on the basis of absorbing original advanced legal culture. And in these outstanding American framers, majority is of great legal reading as the mainstay absolutely, whom this paper called "the American Lwayers". From the start of "Constitutional Debate", "the Declaration of Independence", "Articles of Confederation",1787 Constitution of the United States'formulation and approval by the states, to "the Bill of Rights" becoming an important part of the constitution in December 1791, when constitutional system is established finally in the United States, professional lawyers for main lawyers have take a leadership position.This research analyses lawyers' effects,especially outstanding contributions to the American constitutional system,from the perspect of the subject.Based on the research of the lawyers in that constitutional movement 200 years ago,the purpose of this paper is try to propel the foundation of constitutional system in our country and urged Chinese lawyers to go for our country's political civilization with all their hearts.
