The Legal System Of Corporate Environmental Responsibility

After more than 30 years' efforts, we have known more about the environmental issues. The profounder study we have, the broader range of the government environment we get. We have increased the investment year by year to protect the environment, and the system of environmental management becomes more legal. However, from the current situation of the world environmental protection and management, we can't restrain the trend that the global ecological environment continues to deteriorate. The dominant idea that we should keep our eyes on economic growth has not been fundamentally reversed. Therefore, from a global perspective, it is required that we should strengthen the environmental protection and pollution control in depth and breadth.Since the foundation of New China, we have taken the development path of the high input, high consumption, high pollution and low efficiency. The extensive economic growth mode caused excessive consumption of our resources, environmental pollution and serious ecological damage. The mode which does not take the level of resources per capita into account, ignore the overall environmental capacity, emphasize the number of the growth one-sidedly, and despise the quality of growth has come to an end. Therefore we must put the enterprise environmental responsibility into practice immediately.At present, the issues of the environmental resource become increasingly prominent. The reality and the relations between the state of environmental resources and the economic development make the most of the corporate realize that to shoulder the responsibility to environment and humanity is the important means to strengthen the development of corporate constantly.Corporate environmental responsibility has become a new topic in the study of the theory in our country at present. In this paper, I make a study of the corporate environmental responsibility from an environmental point of view.This paper consists of four parts.In the fist part I analyze the development process of corporate environmental responsibility and define the meaning of it. This kind of study can help us sort out the development of corporate environmental responsibility to provide the potential of analyzing it.The second part focused on the necessity for corporate to undertake the environmental responsibility. Developing the green economy and realizing green development become important choices for many countries. Also, it is the most difficult task for each corporate to develop. Therefore the corporate in the operative activity process considered fully it to the environment and the resources influence, integrates the environmental protection the corporate management and operation the entire process, causes the environmental protection and the corporate development merges into one organic whole, while it obtains the development, the protection and the resources continues the advantage to the environment to exhaust the responsibility. Realizing corporate economic efficiency and the environment benefit harmonious unification.The third part explores the present situation and implementation mechanisms China's corporate environmental responsibility. And it also compares the current situation and implementation of foreign corporate environmental responsibility. Therefore, we can get the experience to implement our corporate environmental responsibility. By comparing the United States and Germany, we see the positive results of developed countries implementing corporate environmental responsibility. Although our country has got some achievements, but overall, there are many problems. For example, the environmental impact restricts the growth of the economy. We find the reason from corporate and government. Thus we get the strategy for the implementation of corporate environmental responsibility. Government regulation is the key to the implementation. Market orientation is the motivation of it. Therefore, we must strengthen the monitoring and supervision and promote the social collaboration.The fourth part elaborates improving corporate environmental responsibility in our legal system, analyzes the related to the security system to establish and implements a corporate commitment to environmental responsibility basis. Building a sound corporate environment risk system is important means to achieve environmental responsibility to environmental risk management and corporate strategy. It is modern solutions to the crisis of the corporate environmental problems which takes the uncertainties to the active and integrated management. Corporate should obtain more information on corporate environmental risk to better perform environmental responsibility. It is to achieve the balanced environmental and economic benefits through corporate production and business activities. The management of corporate in the environmental risk is to discover, analyze and estimate risk to seek the best most appropriate policies to achieve the minimum cost maximum effectiveness of environmental risk management. Therefore, we must make the corporate environment risk system displays effectiveness, we must consummate the green insurance system, the environment accounting system and the environmental information disclosure system.On March 31, 2007, the Chinese Environmental Culture Promotion Association sponsored and organized the "Green China - Environmental Community Day" which held throughout the country. And the 21 non-governmental environmental protection organizations issued"the proposal of Chinese environmental protection"which proposed that the entire society give the pressure to the corporate which exceeded the pollution discharge b by consumer option to promote the corporate to take the proper responsibility. The proposal of"the green choice"indicated that the environment question becomes the focus of attention day by day, because the corporate which causes the environmental pollution in the production process, will face the administrative penalty of the Government department and the pressure made by the consumers. All these shows that the concept of a harmonious business environment as a guide to establish the responsibility system is imperative. Corporate as the main body and guiding force plays a vital role in the improvement of corporate environmental responsibility .It is the key to building a harmonious society. Therefore, corporate environmental responsibility should be based on harmony as the center under the circular economy. And the implementation of corporate environmental responsibility is a slow process. This paper discusses the origin of the environment, focuses the necessity of assuming the environment and the protection of corporate environmental responsibility to implement the system, but there are a number of deficiencies. The good news is the responsibility of Chinese environmental research has made great achievements, will continue to develop and achieve a more brilliant achievement, this paper will continue to research.
