Research On Unions Responsibility In Realization For The Right Of Social Security

Right of social security means that when citizens lose the ability to work or work opportunities or other disasters and difficulties, they can access the material assistance and other forms of services from the state and society to meet their basic survival quality of life and even enjoy the social general welfare needs. It is a citizen's fundamental right. As the subject of the right of social security, citizens are universal, specific and stereoscopies on the characteristic. The so-called universal mean that right of social security covers all citizens, is not limited to any class, each project of the social security is expanded to all personages needing, the right is innate, unalienable, not limited by any factors such as the nationality, race, complexion, faith, job, inhabiting the region. The so-called specific mean that the social security for each project has its own object, such as: special care suit for the military community, social insurance suit for the labor. The so-called stereoscopies mean that each citizen has the right to enjoy the various social security programs .Though different social security programs suit for different application groups, this does not affect the citizens in the enjoyment of the rights of different projects for example, poor can enjoy the society salvage, the worker can enjoy the social insurance, two can also enjoy the social public welfare at the same time. Right of social security includes: social relief, social welfare, and social preferential rights. Social insurance is divided into the right social security pension rights, health insurance rights, and the right to maternity insurance, industrial injury insurance right.The experience of western welfare state shows that social security rights of citizens can not be provided by the state and government ,it needs mobilize all the forces of society (including government, society, enterprises and individuals, including labor unions and various non-profit organizations) together to build a large network of social security protection. The labor union is government's partner, particularly in social security. Its basic responsibility defends the staff legitimate rights and interests, so strengthening the labor union is significant to the social security management participation and the surveillance. The labor union's unique mass character and the public welfare characteristic cause it to participate in the mechanism in the social security domain activity itself on the constitution public the constituent. At present, in our country social security field, the function which the Non-Governmental Organizations displays is limited. Therefore strengthening the labor union the sense of participation and the labor union social responsibilities in the social security field, maintaining laborer's social security rights and interests is very important. In the practice, our labor union is very active in the social security field. After the reform and open policy, the labor union implemented the labor union's basic responsibility, reformed the social security's system, for example: assisted the party politics to improve the poor labors'life, promoted reemployment work, improved the labors'the wages and the welfare level and so on, it constituted our country multi-level social security system's, promoted social security systems' development .Text is composed of six chapters. The first chapter is the introduction of the article, introduces the research background, topics significance, the core point, research significance, content and theoretical assumptions. In the second chapter, explained the relationship between the labor unions and the realization of the right, firstly, introduced the meaning of right of social security and basic content of right, secondly, illustrated that safeguarding the rights and interests of social security is the community responsibility of the labor union.In the third chapter , firstly analyzed and summarized the positive result that our labor union has gained in participating social security(has participated in a greater or lesser extent, showed the special function, appeared some successful examples), summed up China's labor unions to participate in social security system is running a major role in the legislative source for the participation and promotion of social security law and policy development , participating and building maintenance of social security rights monitoring mechanism, helping and supporting the work of mutual aid, building additional social security system. In the fourth chapter, analyzed the problems of China's labor unions which limited union's work. In the fifth chapter, drawing international social security system, safeguard the social security rights of labor unions powerful experience of countries and regions, these regions including Hong Kong, France, Sweden. It focuses on analyzing the value and operability of putting them into use. It is also a basis for the suggestions which are put forward in the next chapter. In the sixth chapter of the article, raising four policy proposals in allusion to the current situation: firstly, perfecting the legal system, developing and modifying the "Trade Union Law" and the legal system of social security laws and regulations; secondly, improving the collective bargaining system; thirdly, strengthening the building of labor unions themselves; lastly defining the function of the trade union in maintaining the role of social security rights.The thesis standpoint is: social security is legitimate rights and interests of workers. Labor unions as the representatives of collective rights and interests of labors play an important role in the realization of the social security rights. So labor unions should maintain social security on the primary position, and play the role in protection for social security rights in order to promote the development of the social security system.
