A Study On The International Legal Regulation Of Sovereign Weath Funds

In recent years, the rapid development of sovereign wealth funds has become an important participant in the field of international investment.However,it is not sound that the legal syestem of sovereign wealth funds in legal definition,governance structure,information disclosure and risk management, and still need to further improve.In the international legislative level,the international legislation of sovereign wealth funds is still in its infancy,most legislative efforts have not form a formal legal document.For my country,concerned about the dynamics of these legislative activities,and efforts to adapt to these legal trends,it is undoubtedly of great significance of improving the governance of sovereign wealth funds.With the exception of the introduction and conclusion,the paper is divided into three parts.The first chapter focuses on the concept, characteristics and development trends of sovereign wealth funds, and analyzing the impact of sovereign wealth funds.Although the sovereign wealth funds develops rapidly and plays a key role in the field of international investment,at present international community,it is lacks consistent understanding on legal definition of sovereign wealth funds.This in bound to affect adversely on cross-border investment of adverse effects.The second chapter introduce the legal model for sovereign wealth funds governance and the legal regulationof sovereign wealth funds in host countries.Based on comparative analysis of the more mature sovereign wealth funds in the world, it provides a reference and improves governance model of sovereign wealth fund for our country;by researching into the the domestic laws and policies in European Union and the United States and other recipient countries, it provides a reference which avoids investment risks for China's sovereign wealth funds investment in the world.The third chapter expounds the trend of consistent international legislation of the sovereign wealth funds.By analyzing comparatively of the reality and possibility about international legislation of sovereign wealth funds, under the International Monetary Fund, Organization for Econamic Cooperation and Development, the World Trade Organization three framework, the author provides some suggestions that our country should adhere to the position in the international legislative process of sovereign wealth funds.
