In recent years, under the influence of the financial crisis, many foreign banks turned to be bankrupt, which were the main reasons of the frequent disputes between the banks and many depositors. Certainly, these cases had a direct impact on the interests of depositors. In order to truly protect the interests of depositors and find effective solutions of disputes, it is necessary to make a relatively accurate definition of depositors'rights. However, the relationship between two parties of a savings contract is very complicated. Because of the constraint from the common law, usual practices and conventions, most countries don't ask the two parties of a contract to use a written agreement for contents and conditions. All these factors lead depositors to be helpless in disputes.First of all, the nature of their rights and the type of depositors will be analyzed. Because of the nature of savings contract has always been controversial in the academic field, and different understanding on savings contract in civil law and common law. It is necessary to specify the nature of savings contract. Second of all, through the comparison between the type of depositors'rights in China and foreign countries, through the analysis and research about the rights of depositors when they make financial transactions in self-service banks, and through the observation about the influence on different depositors in China under the global financial crisis, a claim will be made that the protection for the rights of depositors in China should be improved. At last, by analyzing the protection system for depositors in China and foreign countries, a conclusion will be made that only if a relief system be constructed which fit the real situation in China, the right of depositors can be maximum protected.
