The Comparison Of The Rules Of Subsidies And Anti-subsidies Of The EU And The US Under WTO's Frame

As countries become increasingly closer in their trade relations, more and more attention is paid to the subsidies and countervailing issues by countries and international organizations. Countries have enacted anti-subsidy law, and international organizations have also developed constraints to its member States on subsidies and countervailing rules. Because of the differences of countervailing law between countries, it is not good for development of international trade as well as normal operation of international market. Therefore, a comparative analysis to countervailing law is necessary. It has a very important significance to improve States'domestic legislation, reduce trade barriers and promote the smooth conduct of international trade both in theory and practice.This paper is divided into three parts. The first one is about the comparison of substantive rules of the EU's and the US's subsidy and anti-subsidy laws. It mainly makes a comparative analysis of their substantive elements of the anti-subsidy measures, combined with the relevant contents of WTO Agreement on Subsidies and Countervailing Measures; The second part is the comparison of the Countervailing procedural rules between the EU and the US. Combined with the relevant procedures of WTO's Agreement on Subsidies and Countervailing Measures, this section analyzes the differences of certain Countervailing procedure rules of the EU and the US; The third part is the enlightenment to China. First, it elaborates the current situation and the existent problems of Chinese subsidies. Combined with Europe and the United States-related practices, this paper presents countermeasure, providing adjustments for Chinese subsidy policies in order to improve Chinese subsidy system; secondly, this part also analyzes the current situations and existent problems of Chinese anti-subsidy laws. After joining WTO, our anti-subsidy laws have been gradually improved, but there still exists many problems. In the light of all sorts of shortcomings of Chinese current anti-subsidy regulations, we should have an international view and learn from the international advanced experience of European Union, the United States and other countries in order to improve our anti-subsidy law; Finally, through the analysis of the EU and the US countervailing duty investigation to our country, this paper gives some inspirations on China.
