Legal Analysis Of The Ms Liu's Medical Disputes

Abstract As China's current shortage of medical malpractice legislation, there are certain medical dispute resolution of uncertainty, which led to intensified conflicts between doctors and patients, medical malpractice has become a common type of dispute, but the results are often unable to deal with disputes to suffer from side satisfaction, leading to suffering from side distrust the justice system is not conducive to social stability, our medical malpractice legislation and related system calls for reform and perfect. This paper on the analysis of a medical malpractice case, stated, "Medical Malpractice Treatment" and the Supreme People's Court "on the reference medical malpractice trial of civil cases to inform" the shortcomings and put forward sound recommendations related to system and opinions. The case also on the upcoming July 1,2010 implementation of the "People's Republic of Tort Law" Provisions as to damages on medical analysis, clarify its medical dispute resolution in China's significant progress in significance.
