The Analysis Of The Case Of Li-Chun Traffic Accident

Traffic accident crime refers to violation of traffic regulations, which major traffic accidents, causing serious injury, death or property suffered heavy losses to public and private behavior. Today, Traffic Accident crimes have become one of the most common criminal offenses, Our Criminal Law of the Crime of Punishment, mainly for the free method of criminal penalties.Free method of criminal penalties for Traffic Accident crimes both advantages and disadvantages,and particularly obvious drawbacks. For this problem, I proposed to deal with traffic accident crime in the application of criminal mediation system. The criminal mediation refers that, in the criminal case, through the face-to-face contact between the offender and the victim as well as the mediation of the neutral third party, the aim is to promote the communication and exchange of two parts, and to determine the solution of the crime. Because the theory of criminal mediation is not yet mature and more controversial in the academic field, thus resulting in the application of our criminal law is too narrow. The author believes that the traffic accident crime use criminal mediation is not only to punish crime but also to protect human, obtain a win-win results, and in favor of building a socialist harmonious society.This article select a more typical Jinan, Shandong road traffic accident case as an entry point.start from the concept of traffic accident and criminal mediation, then analysis the characteristics of the traffic accident crime.To come out of the necessity and feasibility of the traffic accident crime for criminal mediation system. On this basis, deepens, eventually come to a traffic accident in China's criminal processing system for criminal mediation system design concept. The case also runs through this process, Li-Chun case received a satisfactory solution in the end.
