Research On The Candidates' Rights Protection In College Entrance Examination

Examinees act as participants in College Entrance Examination, they play important roles in administrating college admission and examination. The formation of their rights awareness and the improvement of their rights protection capabilities are the indispensable inner motivation to promote the construction of college admission legal system. Our society and education have put more emphasis on candidates'obligations, while have ignored the rights of candidates for a long time.In recent years, the community has begun to give more attention to examinees'rights with the continual emergence of legal disputes involving the rights of candidates. It's so necessary to make candidates'legal status and rights content clear, perfect candidates'rights expression mechanism, regulate university admission and exam management power, develop candidates'rights protection channel and protect candidates'legal rights earnestly.The thesis can be divided into three parts to research the candidates'rights protection in College Entrance Examination.The first part starts from the fundamental theory research, before analysing the composition of candidates'rights, the paper briefly discusses the concept of the candidates and the rights content, and makes a further exploration for the meaning of the candidates'rights, the sources of law and the exercising principles, then makes a systematic analysis to candidates'rights on the basis of clearly defining the legal status of candidates, the author thinks that the candidates should have the the following 7 rights personal right, equal right, right of freedom of choice, right to be informed, right of participation, beneficial estate, the right to receive judicial remedy, and at last explains the examinees'obligations and reliabilities.The second part makes cases analysis and existing status investigation related to examinees'rights protection. We designs the questionnaire of "the investigation of examinees'rights expectation, possession and awareness" on the basis of referencing to related materials under the condition of National college admission exam in Hubei province in 2009, selects six cities including Wuhan to do sampling questionnaire to study the existing status of examinees'rights possession, rights awareness and especially rights protection to make some conclusions through special analysis combined with some cases.The third part puts forward some policy-based proposals of examinees'rights protection in college admission exam on the basis of part one and part two's analysis. This paper suggests we should put more emphasis on protecting examinees'legal rights and interests through the following steps strengthening the law establishment related to college admission exam, regulating admission procedures, improving examinees'rights awareness, perfecting power monitor and restriction system and developing rights remedy channels.
