The Reflection And Reformation On The Examining System Of Civil Filing Cases In Our Country

The system of civil filing cases occupies an important place in a country's legal system. A country's civil filing cases system is directly related to the party's protecting situation of the right of action. Furthermore, the protecting situation of the right of action is a key criterion for measuring the level of the administration of justice and the level of the rule of law.This article is divided into four chapters. Chapter one analyzes the historical and present situations of the examining system of civil filing cases in China. According to the analysis, it concluded that the long existing civil filing cases examining system can't fully satisfied the need of protecting party's right to sue in the new period. Chapter two analyzes the problems and the reasons for problems of the examining system of civil filing cases. On this basis, Chapter three discusses the nature of the right of action, which is naturalness, foundation, equality, power–control, independence. For that reason, a state can't decrease or deprive the right at random. The last chapter is the consideration about constructing of the registering system of civil filing cases. On the civil filing cases registering system, the action begins the litigation procedure .It protects the right of action at the maximum limit. Among which covers the new,difficult,sensitive civil cases.
