| The Law of Plato is a famous dialogue on politics and law in his old time. The Law, which is an book Plato wrote to make law for a republic city, mainly focuses on the thoughts of Plato after his turning from"Rule by a Philosopher"to"Rule by Law"and includes a lot of thoughts on Jurisprudence. Jeremy Bentham, whose thoughts have influences on philosophy economics and law especially on British legal improvements at that time, is a famous philosopher economist and jurist on 19th century. Although Plato is a famous person of the classic theory of natural rights which Bentham fiercely objects to, in their thoughts they face many common points which include the analysis and demonstration of human nature including the theory of happiness and pain. Research on these problems often makes us know more about the legal philosophy behind them. This thesis chooses the angle of the theory of happiness and pain to analyze Bentham's and The Law's thoughts and make a comparative research on them. Firstly, the article argue the importance of the theory of happiness and pain and its connection to jurisprudence. then, the article make a general comment on the two comparative subjects of itself and get an impression on them. At last, the article chooses some comparable points from the two unique subjects to make a research on their details. |
