Chinese Criminal Law clearly defines 15 types of crime of pollution of the environment and environmental resources , which make the punishment of environmental crime systematic and feasible, but the legislation in this area is relatively messy and fragmental,so I sort out existing legislation system on bearing of environmental liability, and compare it with the relevant legislation in other countries and regions, in this way, I identified shortcomings in current systems, such as lack of clear policy guidelines for environmental crimes, tedious methods of bearing of environmental criminal liability, over-reliance on punishment, imbalance between Crime and Punishment and lack of multiplicity in criminal types. As a result, I try to reconstruct the bearing of environmental criminal liability from aspects of environmental criminal policy, detailed bearing methods of each environmental crime as well as crime types through learning from foreign experiences and combining current practice. I hope my study could promote the process of environmental criminal law research and help achieve its proper role in environmental protection.
