On The Examination System For Real Estate Registration

Registration and examination system is one of core content of real estate registration system. Examination mode for registration has a major impact on credibility of real estate registration,registration efficiency and accountability of registration errors, etc. It is also closely related with alteration mode of real right and construction of unified registration organ. Therefore, there is theoretical and practical significance of theoretical carding to examination mode for real estate registration and practical considering the choice of future legislation in China in this matter.This paper uses historical method,comparative method and law method. On the basis of comparative analysis of legislation of real estate registration and examination mode in developed countries, it considers a mode of real estate registration and examination in China based on the actual situation in our country. It is divided into three parts, the main contents are as follows:The first part is basic theory of real estate registration and examination system. It explains the concept,examination mode,examination object and examination value of real estate registration and examination system. It also explains that our common goal is to protect real estate transaction security regardless of adopting substantive examination and formal examination.The second part is the study of registration and examination system in developed countries. In this part, through investigating and analyzing the registration and examination system for real estate in developed countries, it concludes that although every country has adopted different examination mode for real estate registration, but each country takes relevant measure to ensure the authenticity and legality of registration in the whole process of real estate registration, and each country which is adopting formal examination all have relevant system to ensure that the formal examination can be achieved same effect in terms of substantive examination.The third part is the choice of examination mode for real estate registration in our country. In this part, it analyzes Chinese scholar's respective view related with registration and examination mode for real estate. By learning the advanced experience of foreign countries and considering the actual situation in our country, this paper presents the view as follows:The examination process for real estate registration in China should be a substantive examination which is mainly carried out by real estate registration organ. The current system is not perfect, in order to improve the substantive examination system, we put forward a way of learning from worldwide and lead into real right notarization for real estate registration.
