Independent Regulatory Agencies (The Fourth Department) are tradition-breaking innovations of The United States. Many scholars indicate that it lives under the administrative system, but it is totally different from the traditional administrative system. The first, second and the third provisions in constitution of The United States respectively impower the legislative power, administrative power, and jurisdiction to congress, president and the supreme court. The establishment of independent regulatory agencies is the lively example. They are established by congress through legislation, and in charge of some special economic or social fields and exercising authorities according to legislation principles and delegation scope. They came into being when monopolizing was out of order, and it's main function is to make those competitions to be standardization and to make an effect to guard against the government's arbitrary interfere to the market, and then expand to the social field. Because of its united exercising administrative power, legislative power and jurisdiction, it can't be classified to any one category of three powers, the traditional mind is that because of its management directions are more about administrative affairs, the president has the jurisdiction to those agencies. At the same time, by considering of its particularity, the president's patronage is strictly limited, aiming to keep the independency of these agencies, and this limitation doesn't overpass the stated president's power by the constitution at all. The efficiency of Independent Regulatory Agencies is far higher than traditional administrative departments and justice departments, because of its united exercising administrative power, legislative power and jurisdiction, its special status which is independent of federal government and its professional character. They have taken marvelous effects on economic development and society's stability of The United States, and it also provides concrete references to the institutional reform of our country.
