Research On Administrative Award Procedures

Research on Administrative award procedures is an important part of administrative law,administrative award as one of the means of China's new administration management,giving positive effect to promote the efficient government. However, the academic field did not give enough attention on it until a typical case of the South China tiger reward exposure.The reason why the trust principle will be introduced into administrative award, I believe that the trust principle has taken effected in administrative licensing system,both the administrative actions do beneficial for Administrative Counterpart. In practice, the Chief Executive often consider administrative award as a gift for the applicant, Arbitrariness usually appear in the process of grant a reward, The applicant do not know how to seek relief for his own rights. In my opinion,Administrative award procedures should be placed on the framework of administrative procedure law because of China has not yet developed a unified administrative procedural law. The study of the procedure of administrative award should be combined to it's basic guiding principles, thus, I selected trust principle to study on this thesis.With over 30,000 words, this paper is composed of four parts.The major contents are as follows:The first part:First, I explained the concept of the administrative award,the administrative procedure, which related with administrative award procedure. Second, it illustrates the current situation of the administrative award procedures in China and foreign research status.Finally, it explains the relationship between the trust principle and administrative award,Can the trust principle be used in the field of administrative award procedures as the guiding principles? I am trying to conduct a feasibility study about it. The second part:the basic research of administrative award procedures.First, I introduced the general theory of the administrative procedures Second, I explained the administrative award procedures in detail.Finally, I summarized various of legislative examples of administrative award procedures from related law in China. The third part:it illustrates the administrative award procedure regulation path.it contains the system and specific implementation steps, it also contains identification of violation of procedure standards and the consequences of illegal determined. The fourth part:This section mainly explained supervision and improving of administrative award procedures from three ways, including legislation, non-complaint remedies and legal remedies for applicant if he suffered illegal or improper award procedures in the process of the administrative award.
