On The Principle Of Trust Protection Of Administrative Law

The principle of Reliance is a very important principle in administrative law.Currently,this principle is widely used in many countries and regions.However,it is still not mature in the research and application of administrative law in China.The research of the principle of Reliance has a great meaning in building faithful government and protecting the legal rights of citizens.This dissertation consists of three parts and the abstract is as the followings:The foreword introduces the researching motive,the researching area and the meaning of this research.Chapter One,the basic theory of the principle of Reliance.This part dissertates the concept of this principle, theoretical basis (good-faith principle theory, basic right guarantee theory and legal stability theory)and its great meaning in details.Chapter Two,the application of the principle of Reliance in some important countries and regions in the world.This part illustrates the radicating history and application in practice of administrative law in some important countries and regions of the world,such as German, England, America, Japan, TaiWan ect.Chapter Three,establishment of the principle of Reliance in China.This part tries to dissertate how to establish the principle of Reliance in the administrative field in our country. Firstly,it dissertates the status of the principle of Reliance in administrave law .Secondly ,it gives necessary factors of this principle.Thirdly ,it explains the field of its application including the administrative legislation field and administrative legal execution field.The fourth part introduces the protective method of the principle of Reliance.The fifth part dissertates how to prescribe this principle in our administrative procedure law of the future.The sixth part is about its application in administrative permission field.The last part is about the application of this principle in administrative guidance,administrative contract and administrative programming.The conclusion part of this article puts forward the speculation to the principle of Reliance of our country.
