Reflection And Promotion: Study On Government Responsibility In The Urban Housing Demolition

With China's rapid economic development and the rapid course of urbanization, the number of old-city renewal is also increasing; therefore, the phenomena of urban housing demolition happened. The urban housing demolition,involving the main three parties of the government, the demolition and the house owner, is a very complex game of interest activities. In practice, the house owners are in the passive vulnerable position of double power under the executive and the civil oppression, so the phenomena of brutal demolition and violence relocation have frequently occurred, which even develops into serious conflict of demolition. The government, as the main body of controlling macro-economic and expropriating land for urban construction, is to be blamed, which is also exposed the absence of the government's responsibility in the process of urban housing demolition.The author collects extensive literature about house demolition and government obligations at home and abroad, analyses comparative study of correlation, and explores the mature experiences of the developed countries and regions. Based on the practice,the policy,the regulations and the procedures of house demolition, using the qualitative analysis method, the author draws the outline of the relationship model among the demolition bodies and the simple model of the interest game. On this basis, the article is about analyzing that the participants play an important impact on the house demolition activities from the perspective of their respective interests. In particular, the article is about analyzing the phenomena of the absence of the government's responsibility in the process of urban housing demolition. Based on the current situation and causes of the absence of the government's responsibility, this paper proposes to build up a modern accountable government of the spiritual pillar as ethics,of the systems as the host entity and of the system of the ethics and responsibility that is be highly integrated.The article is then to analyze the reasons of the government's lack of responsibility from two aspects: spirit and mechanism. On the spiritual level of building up a modern accountable government, it is required to establish new administrative concept and the new rule of law; it is also required to restore the basic spirit of public administration ethics: fairness and justice. On the mechanism level of building up a modern accountable government, it is required to clarify the government functions,define the public interests scientifically,establish and perfect a sound monitoring system,improve the construction of government's responsibility and establish the protection mechanisms for the house owners'rights est. According to the analysis of the previous text about the construction of responsible government, the paper depicts a sound relationship model to achieve the balance of interests among the main demolition bodies, resolve all sorts of disputes and protect the legitimate interests of the house owners effectively. The author thinks that it is the general consensus and strong demand to establish a responsible government. The author also believes that,the responsible government means much to the society, so long as a government is a responsible government, it surely is a legal, a democracy and a fair government. Only a government set up a correct responsible idea, clear about the responsibility which it shoulders and actively and earnestly fulfills these responsibilities, can become a responsible government in the true significance.
