Legal Studies On Administrative Compensation Procedure

State Compensation Law has been implemented more than 10 years. In recent years, the voice of law experts to amend the Law is getting higher and higher. Public have made many of their suggestions and ideas to amend the law. For the long-term concern and personal preference, the writer selects the subject.There are six chapters in total, as following:Chapter 1:"preface", this chapter discusses the purpose and significance of the paper, reviewed the literature, writing methods and possible innovations.Chapter 2:"subsistent law-China's administrative compensation procesure", this chapter introduces China's administrative compensation procesure completely.Chapter 3:"comparative law-administrative compensation procesure in other countries and regions", is divided into three quarters. Administrative compensation procesure in other countries and regions is introduced and compared.Chapter 4:"supposed law-due administrative compensation procedure", this chapter demonstrates what is due administrative compensation procedure on jurisprudence.Chapter 5:"reformation law-to amend our administrative compensation procedure", some defects are analysised. We must make some principles and systems of administrative compensation procedure. At the last there are some suggestions of reformation.Chapter 6:Finally, the writer gets a conclusion, there are many unreasonable points, which are not match with due process, and we must construct our due procesure.To construct our due administrative compensation procedure, we must set up it's principles and specific systems, expanding the scope of applicants. We can set a new independent authority. Reconsideration and litigation will ensure justice.
