| Administrative monopoly has always been a hot issue and can be seen everywhere in daily lives. Administrative monopoly does seriously harm to the society and has become the obstacle of market economic development. Under the impact of integration of world economy, legal regulation of administrative monopoly is an immediate necessity. Base on previous research, this article adopts theoretical study, empirical study and comparative study and other methods to make in depth research on administrative monopoly. Suggestions of legal regulation are provided as well.The main body of the article consists of four chapters.In chapter one, the conception, feature, cause and harm of administrative monopoly are analyzed. The value of regulating administrative monopoly is the Inherent requirement of establishing socialistic marketing economical system. It is also the objective requirement of ruling the country in accordance with law, the guarantee of improving administrative subject ruling ability and the inevitable choice of joining the WTO.Based on the theory of the previous chapter, chapter two presents the history and current situation of anti- administrative monopoly in China. It breaks the limit that previous researches only focus on the law aspect. This chapter not only researches on the law clauses but also carries on individual studies on executive sectors and the routine of execution.The third chapter continues the research method of the second chapter, by comparing the regulation of administrative monopoly between transformation system countries (Russia, Ukraine etc.) and developed countries (Japan, Germany, European Community etc.), the deficiencies in legislation, execution and legal liability of Chinese anti- administrative monopoly system are identified.Affirming that law is the effective approach for regulating administrative monopoly and adopt the advantages of the foreign countries system, the fourth chapter makes evaluation and recommendation for improvement in legislation, execution, legal responsibility and supervision of the current Chinese administrative monopoly regulation system. |
