The Research On Legal Protection Of Investigative Reporters' Rights And Interests

In the fields of journalism and law, there art two research perspectives to discuss the relationship of the law and press which are constraints and protects. In contrast, academic research on the former is more fully, the latter studies are slightly less. It's both valuable from academic to practice to research reporters'rights and interests, who is the main body in the press practice. Rights violations suffered because of his behavior is a common problem faced by journalists groups. This article from the start of investigative reporter who is most vulnerable to rights violations, combining journalism and legal theory, is in order to study on how to protect reporters'rights and interests with law.This article is divided into four parts. The first part is introduction, to introduce the research origin, research value and research methods. The second part, is to define the concept of investigative reporters together with their characteristics. This part also divides the investigative reporters into professional rights and ordinary equity interests. The third part does a detailed analysis of the features and causes of the behavior against the investigative reporters'rights and interests. It lists five law levels to protect investigative reporters, including Constitution, laws, regulations and other policy documents and international conventions. It also gives a brief assessment of the legal documents of various levels. In the last part, it beyond the scope of investigative reporters, from the journalists group and information activities, evaluates the existing legal system of positive and negative aspects to protect reporters'rights and interests. On the one hand, it tries to give improving answers under the existing legal system; on the other hand, it proposes to formulate the "Press Law". The article cites the strong desire of the press law from the society, and discusses the necessity and characteristics of the "Press Law".From the practical view, this article attempts to provide a realistic model to protect the investigative reporters and the whole group's interests; From the academic view, it has a certain reference value to the research of related issues. Finally, this article's analysis and evaluation of the law, giving some judicial recommendations, is in order to inspire and improve the promotion of justice.
