Study On China's Legislative Improvement Of Defective Product Recall System

From the global scope, the events of defective products threaten the social publics'personal and property safety taken place repeatedly. As a advanced system who hasestablished and implemented universally in developed countries, the defective product recallsystem makes a great impact on ensuring the consumers'life and health safety, regularizingmarket economyorder and promoting producers to increase the product competition power. InChina, the defective product recall system has carried into effect for nearly six years, and inthe process, the legislative branch have set up our elementary defective product recall systemthrough founding special recall regulations in particular products fields such as cars, food,drug and children toy. However, a large number of cases about defective product recallhappened in real surroundings at home and abroad is reminding us constantly: whethercompared with other developed countries, or depend on the current times background, thereare still many factors that call for lawmaker to perfect as soon as possible in our country'sdefective product recall system. In the first, this article expounds the basic theory ofinterrelated concepts, nature and function about the system, on this basis, by analyzing theimplement actuality of the system in our country, I sum up some disadvantage and shortage inthe development of our recall system, and researches what can we get from other developedcountries through a comparative perspective, on that basis, I proposes some rationallegislative constitution for building our country's defective product recall system based on thesituation of our socialist construction.
