Publication Of Draft Bill: The Functions And Systematic Construction

It is an important way to develop the socialist democratic politics and make the people be the master of their own if the citizens can take part in politics orderly. It is also an essential reflect for citizens to take part in the law making process. Law making practice proves that the mechanism of legislative participation can endow the law with legitimacy, democracy and authority. which can make the law acquire more public identity.According to the decision making by the Chairmen's Council of Eleventh National People's Congress at its Second Session meeting. all the draft bill made by this origination ought to be promulgated and should ask for suggestions from the public. However, this is a principal decision. So it needs more specific regulations to ensure the realization of its original intention.This paper includes four parts, the first part try to define the objiect of this research by interpreting and analysis the related concepts. the second part is about the practice of public comment bill legislation in our country. It gives the foundation of law bill's open and the historical practice of public comment bill legislation. the third part analysis problems such as the unclear feedback mechanism and less documents related draft bill. And then, it gives a proposing that we should explore more ways to public a draft bill and establish feedback mechanisms for smooth open mechanism for the improvement of the draft bill.
