The Research On Selection Of Hearing Representatives For Government Regulations Legislation

In recent years, some local governments started the pilot program of adopting hearing in the legislation of government regulations, and had formulated some specific standards for the selection of the hearing representatives. But due to the short of related system and lack of practical experience, not every one (interest party) can have the opportunity to defense himself/herself in practice. Besides, in consideration of the system, no systematical and matured operation rules for the selection of hearing representatives existed.This Paper, by using Shanghai as an example, analyses such problems existed in the use of legislative hearing in the process of formulating government regulations as the elusive standards for selecting representatives, citizens'low initiatives of participation, improper selection modes, etc., studies the path of improving the representative selection system systematically, and puts forward suggestions on itemizing the selection system by studying and demonstrating the determination of selection principles, scope, standards, and procedures, so as to lay the foundation for the improvement of the quality of both the hearing and the legislation, provide theoretical modes for the formulation of corresponding procedures, continuously raise the government's legislation quality, and push forward the construction of a rule-of-law government.
