Research The Crowed Legal Action

Since last century of 80th , As gradual explore of Chinese open-up, crowed dissension and crowed case was raised accordingly, attracted both of sociology and the science of law field. The law experts focused on the oversea , fully inspected the American system of group legal action,German system of team legal action,Japanese system of selected party and so on. On the basis of borrowing and sucking, formed Chinese system of representative legal action. But the effective of this system was not obvious, neither social effective. On the basis of full inspection from oversea systems, The article mentioned some suggestions which improved our concerned systems.Besides summary and foreword, the article include four parts.Part one summarize of crowed legal action system, it limited the conception of crowed legal action system renewedly, and interviewed the existed background of crowed legal action system.Part two inspection and compare from oversea crowed legal action systems. In this chapter, after inspecting some systems from oversea country such us America,Germany and Japan, then compare the crowed legal action systems between these three countries. Part three compare between Chinese representative legal action system and oversea crowed legal action system. In this chapter, introduced detailed for Chinese representative legal action system, compared it to concerned systems from America,Germany,Japan. Meanwhile, analyzing the advantage and fault which come from Chinese representative legal action system.Part four improved suggestions for Chinese representative legal action system, discussed some methods which relay on law improvement and import team legal action system, then improve Chinese representative legal action system.
