Study Of Environmental Dispute Resolutions In China

Environmental Dispute Resolutions begin to be taken positively and new relevant resolutions are continuously developed in practice nowadays when a series of environmental disputes and conflicts brought by the highly development of the economic society appear. Within the present Environmental Dispute Resolutions system in our country, resolutions on the environmental disputes include: The parties settle on their own, compromise solution, People's Mediation Committee for mediation, Administrative processing by the competent department for environmental protection, litigation and arbitral settlement on environmental disputes, etc.. With the increase of environmental disputes, It seems that a diversified and all-around environmental dispute resolution system in China which centers on the environmental litigation was put into operation on the aspect of sustaining the social order, solving conflicts of environmental interests to some extent; however, the above-mentioned solutions are not so complete and the legal proceedings are not so rational for which a coordinated and highly efficient diversification mechanism can not be formed, and they can not satisfy the need of social development and practice, so the present situation of the environmental dispute solution makes people concern much about it. It is necessary to explore further on the environmental dispute solution mechanism, so that it can be improved and applied to solve any environmental disputes effectively and duly, lawful environmental rights and interests of citizens can be safeguarded, a harmonious and sustainable social order can be established. In this paper, the author starts from the concept and characteristics of the environmental dispute to explore and analyze the present situation and problems on it, and will put forward some proposals on the improvements of the environmental dispute solution mechanism in our country.
