Migrant workers in China is a unique group, this group has made great contributions to China's urbanization process. But in the reality, their income and national treatment is not in proportion with their contributions, and inductrial injury accidents often happen. Their behavior tendency of maintain legal rights in inductrial injury accidents caused many public management problems, has become the focus in academic circle and society. State and local government has issued a lot of relevant policies and regulations, but in actual investigation the writer found that the formal rules and regulations are ineffectiveness.The customs and habits consisting informal system have a far-reaching influence on migrant workers' behavior of maintaining rights after inductrial injury. When choosing the de-institutionalized method of maitaining their rights, the migrant workers would rather give up the high compensation of law, but to choose unmaximization benefit method. For migrant workers' behavior choice, the author argues that is not only described in the media rights "difficult" program problem, but is the deeper social order problem of the basic aspects of system. Thus when the author interview the migrant workers and analyse the behavior of maintaining rights, and aslo affect the value judgment, two operation system--the government and the employer. Then tried to use small sample of case to study the causes of the problems deeply, and puts forward the corresponding countermeasures.Human society couldn't be advanced without constraint and regulating system, the ultimate expression system is the relationship of the social members, reflects the relationship between the power, the free in formal constraint system behavior will only make social development into chaos or low efficiency. The author thinks the non-institutionalized rights mode will hinder social progress and development in begin and order. The government should establish systematic error correction mechanism, and construct the system environment for migrant workers maitaining rights, to arrive at the social efficiency and the public welfare benefits, which can make system evolve along the direction of improving the effect of society.
