Research On The Interests Integration In Legislative Process

Mankind is an animal who pursuits interests, human behavior is based on the interests. With the social development, diversification of stakeholders will inevitably bring about the differentiation and conflicts of interests. In recent years, house demolition and other social hot spots, which reflects the public interest and private interest becomes increasingly unbalanced, endless conflicts aroused people's attention. The emergency of these social problems, public interest and private interest conflicts there, a very important reason is that the public interests' connotation and extension in legislation is unknown, so the name under the guise of public ,interest, and abuse of public power, the case which against the individual interests often occurred. For this case, first,the author summarizes the views of Chinese and Foreign scholars on the interests, analyzeing interests attemps to define the public interest and private interest. Through the research by scholars at home and abroad, analyze the relationship between public interest and private interest, focus on the level of unity and opposite, and competition game relationship. Second, to analyze the level of legislation, the legislative process of the interests involved, an the choice of legislation and coordination of benefits. From the perspective of the current legislation, analysis of constitutional law and sector legislation in the public interest and private interests' integration, which showed integration of the existing legislative system deficiencies. Finally, we should pay attention to careful treatment and protection of private interests in the legislative process, to improve the expression of interests and build a sound environment for integration mechanism,and improve legislative oversight system. Through the three aspects, hope to establish a harmonious relationship between the public and private interest, which is also one of the main objectives legislation pursued.
