Study On Intellectual Property Protection Of Chinese Traditional WuShu

Traditional Wushu as an important partition of our traditional culture is our precious intangible cultural heritage,which presreves the most connentrated nationl and local characteristics,and what's more,through the filtration of each era,it is the product of the intellecual labour retaining the cream of a nation. But because of its existing way, practicability and significant aspects is different from with the modern knowledge,so at present, traditional Wushu has been not specifically taken into the system of the intellectual property law to be protected in China,at the same time there has been not a dedicated law to Chinese Wushu. Defects in the law seriously hinder her heritage and development.The Intangible Cultural Heritage Law of the People's Republic of China, which was adopted at the 19th Session of the Standing Committee of the 11th National People's Congress of the People's Republic of China on February 25,2011 is important to protection of our traditional wushu,and its appearing will also to gives a firm protection to the work of the intangible cultural heritage.However, the traditional martial arts as a kind of Intellectual property, its innovation and development will need the " protection of the intellectual property ".therefore, strengthen the protection of intellectual property to our traditional wushu must be done without delay.From the non-material cultural heritage point of view,This article analyzes the concept and characteristics of the traditional wushu, through "the case of Jet Li applying for a patent to his wushu movements ", "shaolin trademark registered case "series events, analyzes feasibility of space in the law of intellectual property to protect the traditional wushu. This article we are make a rudimentary exploration to the problem through the following four parts:The first part, mainly discusses the notion of culture and features of the traditional Wushu,and the same time the article explaines the concept of the intangible cultural heritage, summarizing the the actual state of protection to traditional Wushu.The second part, through "the case of Jet Li applying for a patent to his wushu movements etc,discusses a problom of the traditional wushu not applying to modern patent system, but applying to copyright protection system. The third part, with the study of protection from trade mark protection system to traditional wushu., elaborate that registered trade mark is an effective way to protect the traditional Wushu.The last part, makes a research on legal protection to the tradition wushu,and deems that strengthen the protection of intellectual property to our traditional wushu must be done without delay.Anyhow, the traditional wushu is our precious intangible cultural heritage,and we should establishe a law dedicated to the protection of teaditilnal knlwledge,to develope the national "soft strength " and accomplish the great rejuvenation of the Chinese nation.
