Study On The Safety Problems On Campus And Strategies

With the continuous deepening of the reform and opening of China and the continuous development of economy and society, great importance is being attached to education. Today at the 21st century, education has been entitled the historical task of "cultivating the high-level professional persons with creative spirit and practical capability, developing science, technology and culture and promote the socialist modernization drive"in the form of law. The school is the main performer and undertaker of the arduous task; therefore, it is of great importance at the times to assure the safety at campus and improve the teaching level of the school. With the continuous occurrence of various social contradictions, the problems of the safety on campus become more and more prominent and the situation of the safety on campus also becomes more and more severe. The school as the pure land in the people's mind is being damaged by various factors, which has become a hidden trouble influencing the major education program and even the social stability. The author, as an administrator engaging in the education at the grassroots level has some perceptual knowledge of the problems of the safety on campus and try to present some opinions of the problem. The paper is divided into three parts.% In Part 1, the present situation of the safety on campus is dealt with. Firstly, the factors influencing the safety on campus are analyzed. Some factors come out of campus, mainly included as follows. The first is unlawful infringement. At present, it is in the transitional period of society, various contradictions are becoming increasingly prominent some extremists who are not satisfied with society show their bad mood on campus. The second is traffic accidents. The traffic accident is now the No. 1 murderer of accidental death, which is not exceptional to students. The third is food poisoning. Food safety is becoming the primary question influencing our health. The campus with the density of population is easier to be damaged by unsafe food. Once food poisoning happens, a group of persons are dead or injured. Some reasons come on campus, mainly included as follows. The first is accidents, which refer to some accidents caused by the irresistible force. The second is accidents arising from one's negligence. One category is related to the school and teachers, the other is related to students and guardians and another is related to students and the third party except the school. Secondly, the reasons influencing the safety on campus are analyzed. Some reasons come from society, some come from the family and another come from the school. In Part 2, the problems existing in handling the problems of the safety on campus are dealt with. Firstly, the current relevant laws and regulations on the safety on campus in our country are analyzed. Secondly, the defects of the current laws and regulations on the safety on campus are analyzed. The first defect is the incomplete legal system. The second is unclear legal responsibility. At present, no special law has been established to standardize the relations of rights and obligations between the school and the teachers and faculty and students under the protection of the school. The third is no smooth channel of relief. Although there are more and more proceedings on education in recent years, the impact of these proceedings on the human concepts is far bigger than that on the legal system on education. Viewed from the actual situation, the inadequate ground for the proceeding law still cannot make the safety problems on campus smoothly enter the channel of judicial relief and the means of relief still lack rigidity. In Part 3, the strategies for the safety problems on campus are dealt with. Firstly, the feasibility of the special legislation on the safety on campus is analyzed. The first is the social voice. For many years, the persons at all walks of life, especially the deputies of the National People's Congress have been calling on to accelerate the pace of legislation and make the safety work in the school carried out in accordance with laws and regulations. The second is the support of theories. In recent years, a lot of theorists in the educational and legal sectors of China have given their viewpoints and carried out many beneficial discussions, which provide important supports for the nation establishing the law on the safety on campus. The third is practical experiences. Recently, some experiences have been accumulated in participating in the handling of the safety accidents on campus, the investigation of some special topics has been given and some measures havebeen taken to prevent the accidents from happening and appropriately deal with the accidents in the local legal, judicial and educational sectors. The fourth is the support of the current educational legal system. The fifth is the international legislative experiences that can be used for reference. The emphasis is given on the analysis of the experiences of the laws on the safety on campus in the US and Japan. Secondly, the strengthening of the education on the safety measures is analyzed. At present, there is a poor education on the safety on campus in our country. In the paper, priority is given to the discussion on some aspects such as the strengthening of the safety mode, the courses on law for the students in the primary and middle schools and various types of propaganda mechanism as well as various safety activities, etc.Thirdly, how to strengthen the management of the safety on campus in the system is analyzed. The first is to enhance the consciousness of safety. The second is to establish the safety network system. The third is to establish the system of safety measures. The fourth is to enhance the supervision and make unremitting efforts. Finally, the strengthening of the establishment of the agency maintaining the safety on campus is analyzed. If the problems of the safety on campus are resolved, it is especially necessary to establish the special agency maintaining the safety on campus in all the schools at all levels in addition to a feasible safety management system. The concrete measures are to establish the police agency and the public security department in the school. The school, the police agency and the public security department in the school should cooperate with each other in the distribution of different powers, which are discussed in details. On this basis, the maintenance of the public security agency and system in the school should be continuously perfected, that is, to displace the concepts, set up the service concept of taking human beings as the most important, perfect the legislation of the public security in the school, rule the school in accordance with the law, standardize the procedure of enforcement of laws, really safeguard the legitimate rights and benefits of the objects and perfect the mechanisms of supervision of enforcement of laws and relief as well as improve the quality of the personnel of enforcement of laws, etc.% The situation of the problems of the safety on campus is severe, forwhich the reasons are complex. The key to resolve the problems lies in the perfection of the educational legal system. And it is also the core content of legislation of the safety on campus to strengthen the education on the safety measures on campus, the safety management on campus and the maintenance and establishment of the safety agency on campus. It is hoped that some of the author's viewpoints can give some implications to the safety management on campus.
