A Study On The Civil Status Of Women In Han Dynasty

As an important part of the social class, the status of women always indirectly reflects the style and features of the society at that time. The Han Dynasty is the foundational period of the feudal society, and its politics and economies had boomed and the construction of its legal system also tended to be mature. There were many policies and laws on women’s rights and interests in the civil law of the Han Dynasty, which clearly defined the rights of women in different situations. So the women’s personal rights and property rights could get the legal protection. According to the ancient books and records and unearthed documents, this dissertation is to research the civil legal status of women in the Han Dynasty and then analyze and summarize the characteristics and factors of the women’s civil legal status in the Han Dynasty.First of all, the social background in the Han dynasty and the women’s social status at that time should be summarized. The comprehensive summary of the social developments of the Han Dynasty should be from the political, economic and ideological aspects, which should demonstrate the historical background of the legal status of women in the Han dynasty. On the basis of the general overview of social developments in the Han Dynasty, the social status of women in the Han Dynasty should be analyzed from the perspectives of the women’s economic status, political participation, and education.Secondly, the status of women’s personal rights in the Han Dynasty will be analyzed and discussed mainly from the perspectives of the women’s right to life, personal liberty, marital autonomy and rights in family. And according to the differences of women’s social stratum, the women at that time will be divided into ordinary women and aristocrat females, which will be discussed by the classification to finally make an overall comprehensive understanding of the status of women’s personal rights in the Han Dynasty.What’s more, the status of women’s property rights should be studied. According to the women’s three important roles in the family including “daughter”, “wife” and “mother”, the status of the women’s property rights in the Han Dynasty will be discussed from the perspective of different family roles.At last, through a comprehensive study of the legal status of women in the Han Dynasty, the characteristics of the times of the women’s civil legal status in the Han Dynasty would be summarized and concluded and the reasons for the formation of the legal status of women in the Han Dynasty also will be analyzed.
