Reproduction is of important significance for human beings. The rapiddevelopment of modern medical technology, especially the invention of artificialreproductive technology, has solved many problems of infertility patients. Artificialreproductive technology includes artificial insemination, in-vitro fertilization,surrogacy and asexual reproduction. This kind of technology is involved in thenatural reproduction process of human, which causes a lot of ethical and legalcriticism.In order to avoid a large number of social problems, many countries have beenpromoting the legislation to regulate such kinds of technology. Compared with theadvanced countries, our country is still blank in legislation in this area. At the sametime, artificial reproductive technology is rapidly popularized in China, and lagginglegislation has been unable to meet the needs of social development. Artificialreproductive technology has caused many disputes in our country, and the judiciarylacks legal basis in dealing with these disputes.This paper summarized the related legislative situation at home and abroad,collected and analyzed the typical cases of domestic, and preliminarily discussed onChina’s legislative blank in this area. Artificial reproductive technology will play animportant role in the treatment of infertility. Especially in recent years, there has beenan increase in the infertile population. Data shows that about15%men and women ofchild-bearing age can’t have children. Therefore, there has been a large marketdemand of artificial reproductive technology. In this case, it is of practicalsignificance to promote China’s process of related legislation, and standardize themanagement of artificial reproductive technology.
